1. Service Description

AcumenLab is an AI-powered ad intelligence platform that provides campaign audits, real-time monitoring, creative analysis, competitor intelligence, and automated reporting for Google Ads, Meta Ads, and other digital advertising platforms. By accessing or using AcumenLab, you agree to be bound by these Terms of Service.

2. Eligibility

To use AcumenLab, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Have the authority to enter into these Terms on behalf of any organization you represent
• Comply with all applicable laws and regulations

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Providing accurate and up-to-date account information
• Ensuring that your use of AcumenLab complies with all applicable laws

4. Acceptable Use

When using AcumenLab, you agree NOT to:

• Use the service for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble any part of the platform
• Use automated systems (bots, scrapers) to access the service
• Abuse or overload our API or infrastructure
• Share your account credentials with unauthorized users
• Upload malicious code, viruses, or harmful content
• Interfere with other users' access to the service
• Use AcumenLab to compete with or replicate our service

5. Subscription and Billing

AcumenLab offers multiple subscription plans (Free, Starter, Pro, Agency):

• Automatic renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled
• Payment processing: All payments are processed securely through Stripe
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period
• Refunds: We do not provide refunds for partial months of service. If you cancel, you retain access until the end of your paid period
• Price changes: We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be grandfathered at their current price for the remainder of their billing cycle

6. Free Tier

Our CSV audit tool is available free of charge with no signup required. Free audits include 75 Google Ads checks and 49 Meta Ads checks. We reserve the right to modify or discontinue the free tier at any time. The free tier is provided "as is" with no warranty or guaranteed uptime.

7. Data Ownership

You retain ownership of all data you provide to AcumenLab:

• Your campaign data, reports, and insights remain your property
• We do not sell your data to third parties
• We may use anonymised, aggregate data to improve our AI models and platform capabilities
• You can export your data at any time
• Upon account deletion, your data is permanently deleted within 30 days

8. AI Insights Disclaimer

AcumenLab provides AI-generated insights, recommendations, and analysis. These are suggestions based on campaign data analysis and industry best practices. You are solely responsible for decisions made based on AcumenLab's recommendations. We do not guarantee specific results, performance improvements, or ROI. Always exercise professional judgement when implementing changes to your ad campaigns.

9. Limitation of Liability

To the maximum extent permitted by law:

• AcumenLab is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• We are not responsible for losses resulting from service downtime, data loss, or third-party service failures
• We are not liable for actions you take based on AI-generated recommendations

10. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to AcumenLab. We reserve the right to suspend service for maintenance, upgrades, or security issues. We are not liable for any losses resulting from service unavailability.

11. Termination

Either party may terminate this agreement:

• By you: Cancel your subscription at any time from account settings
• By us: We may suspend or terminate accounts that violate these Terms, abuse the service, or engage in fraudulent activity
• Data export: Upon termination, you have 30 days to export your data before permanent deletion
• No refunds: Termination does not entitle you to a refund for unused service time

12. Intellectual Property

AcumenLab, its logo, features, and functionality are owned by Digital Growth Labs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

13. Third-Party Services

AcumenLab integrates with third-party services (Google Ads, Meta Ads, GA4, Stripe, etc.). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or functionality of third-party services.

14. Indemnification

You agree to indemnify and hold harmless Digital Growth Labs from any claims, damages, losses, or expenses (including legal fees) arising from your use of AcumenLab, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email and displayed prominently on the platform. Your continued use of AcumenLab after changes are posted constitutes acceptance of the updated Terms.
